POCSO Act, 2012 — Protection of Children from Sexual Offences

POCSO protects children under 18 from sexual abuse, harassment, and pornography. It mandates child-friendly procedures and strict punishment for offenders.

  • Any sexual act with a child is a criminal offence regardless of consent
  • Police must record statements in a child-friendly environment
  • Child's identity must be kept confidential throughout the process
  • Failure to report known abuse is also a punishable offence

Domestic Violence Act, 2005 — Protection of Women

This Act protects women from physical, emotional, sexual, verbal, and economic abuse by any family member or partner. It gives women the right to stay in their home.

  • Right to reside in the shared household, even without ownership
  • Right to protection orders, residence orders, and monetary relief
  • Covers physical, verbal, emotional, and economic abuse
  • Court can issue emergency protection orders within 3 days

Dowry Prohibition Act, 1961 & IPC Section 498A

Giving or taking dowry is a criminal offence. IPC 498A protects married women from cruelty, harassment for dowry, and abetment of suicide by in-laws.

Dowry Prohibition Act

Punishment: up to 5 years imprisonment and fine of ₹15,000 or the value of dowry, whichever is higher.

IPC Section 498A

Cruelty by husband or relatives — imprisonment up to 3 years + fine. Cognisable and non-bailable.

IPC Section 304B

Dowry death — if a woman dies within 7 years of marriage under suspicious circumstances, minimum 7 years imprisonment.

ITPA & IPC Section 370 — Anti-Human Trafficking Laws

IPC Section 370 criminalises all forms of human trafficking — for forced labour, sexual exploitation, or organ harvesting. Trafficking of children carries stricter punishment.

  • Trafficker: minimum 7 years, up to life imprisonment
  • Trafficking of children: minimum 10 years imprisonment
  • Victims have right to free legal aid and rehabilitation
  • Victim's statement recorded in private with female officer

Absolutely. All personal information shared with Bhavini Foundation is strictly confidential. We never share your details without your explicit consent, except in cases of immediate danger to life where legal obligations apply.

How can I refer someone in need?

Call our helpline directly. You can refer a friend, neighbour, or family member by sharing their situation with our team. We'll reach out sensitively and offer support. You don't need the person's permission to make a referral — our team will handle it carefully.

How are donations used?

68% goes directly to program costs (counselling, legal aid, workshops), 18% to community outreach, 9% to administration, and 5% to our future shelter home fund. We publish annual impact reports. All donations are eligible for 50% tax deduction under Section 80G.

Do you offer services in Hindi?

Yes. All our services, workshops, and helpline support are available in Hindi. We work primarily in Uttar Pradesh and understand the linguistic and cultural needs of the communities we serve.
